A1. Acceptance of Conditions
Welcome to the Red Horse Vale Limited Website. Red Horse Vale Limited is the trading name of Red Horse Vale Limited, Windmill Farm, Banbury Road, Oxhill, Warwickshire, CV35 0RP.
By continuing to use the Website, you are indicating that you accept these terms and conditions of use and sale.
A2. Orders placed Online
The Buyer will receive an email from the Red Horse Vale Limited (Seller) confirming that the order has been received and is being processed. This email does not confirm that the order has been accepted. By placing an order, an offer is made from the Buyer to the Seller to make the purchase. There will be no contract between Buyer and Seller until the goods have been dispatched. No contract will be established if the Seller informs the Buyer that the order is declined or if the Buyer cancels the order. The Seller does not keep details of previous orders for the Buyer to access on the Website.
A3. Price
For all orders placed through the site, the price charged is that shown on the website and paid electronically as part of the order process. Prices shown are exclusive of VAT, which is charged in addition during the checkout process at the appropriate rate applicable at the time. The Seller is not obliged to give the Buyer a lower incorrect price, even after the goods have been dispatched, if the pricing error is obvious and could reasonably have been identified by the Buyer as a mispricing. If the Seller finds an error in the pricing of products, they will inform the Buyer as soon as possible and give the Buyer the option to reconfirm the order at the correct price, or alternatively to cancel the order. If the Seller is unable to contact the Buyer, they may regard the order as cancelled.
A4. Payment
The Buyer will make and the Seller will collect payment through the checkout process on the Website at the time of order. A secure server will operate all card payments made online. The Buyer will have to re-enter payment details with each order.
A5. Title and Risk
Risk of loss of or damage to goods will pass to the Buyer as soon as a contract is established between the Buyer and Seller. This will normally be on dispatch of the goods.
A6. Delivery
All items are offered for sale subject to availability and delivery cannot be guaranteed. The Seller will arrange, when requested, to deliver all orders either through the services of a contractor or with its’ own transport. Some items will only be delivered within a 30 mile radius of the Red Horse Depot at Oxhill. The Buyer must be prepared to accept delivery at any time during normal business hours. During the checkout process, the price does not include nationwide delivery. The Buyer is to contact the Seller direct, for a quotation before placing an order if delivery is required nationwide. Buyers are also welcome to arrange their own collection of their purchases.
A7. Security of Data
The Seller will at all times comply with the terms of the Data Protection Act and keep any personal details of Buyers safe and secure.
A8. Cancellation of Order
Any order may be cancelled by a Buyer at any time before dispatch.
A9. Returns
Not all items are returnable – where necessary the position should be established in each case. If items are returnable, they may be returned within 28 days of purchase for a full refund minus any delivery costs, provided that the goods on return are unused and in a saleable condition. Such refunds will be processed within seven days of the receipt of the returned goods.
Standard Conditions of Sale – Oil Products
B1. Price
For all orders other than those placed through the Website, the price charged is that ruling on the day of ordering irrespective of the date of the order is delivered.
B2. Payment
The Buyer will make and the Seller will collect payment through the checkout process on the Website at the time of order. A secure server will operate all card payments made online. The Buyer will have to re-enter payment details with each order.
B3. Quantity
The volume of delivered goods shall be gauged by the meter on the Seller’s fuel tanker, which shall be conclusive as the volume of the Goods delivered.
B4. Title and Risk
Risk will transfer on delivery of the product. The product remains the sole and absolute property of the Seller until such time as the Buyer has paid to the Seller the full and agreed price. The Seller may for the purpose of recovery of his products enter any premises where they are stored or thought to be stored in order to repossess same.
B5. Delivery
Delivery will take place when the product passes the connection point or coupling between the Seller’s and Buyer’s equipment. The Seller will use best endeavours to supply product within a reasonable time of order, but no responsibility exists for any direct or consequential loss arising from any failure to deliver by a specified date.
B6. Cancellation of Order
Any order may be cancelled by a Buyer at any time before dispatch. The Seller will process the refund to the payment card used to place the order which will take a few days.
B7. Liability
It is the Buyer’s responsibility to ensure that legal, safe and suitable storage is provided for the delivered product, and that sufficient space exists for the quantity ordered. The Seller shall not be liable for any loss or damage whatsoever caused by, arising out of, or in connection with the use or handling of the Seller’s goods after the risk therein has passed to the Buyer. The Buyer shall indemnify the Seller against all costs and expenses incurred by the Seller in connection therewith, including the costs and expenses of investigating any such claim.
B8. Force Majeure
The Seller shall not be responsible for any failure to make deliveries if fulfilment has been delayed, hindered or prevented by any circumstances whatsoever that are not within the Seller’s immediate control.
B9. Waiver
Any relaxation or concession that may be granted by the Seller in respect of any term of this agreement shall in no way affect or prejudice any other of the Seller’s strict rights hereunder.

Acceptance of the delivery of the product will be deemed to be acceptance of these conditions. No variations of these terms will apply unless specifically agreed in writing between the parties prior to delivery.
Standard Conditions of Sale – General Products
C1. Price
The price charged is the price agreed upon order, irrespective of the price on the day of delivery.
C2. Payment
The Buyer will make and the Seller will collect payment through the checkout process on the Website at the time of order. A secure server will operate all card payments made online. The Buyer will have to re-enter payment details with each order.
C3. Cancellation of Order
Any order may be cancelled by a Buyer at any time before dispatch. The Seller will process the refund to the payment card used to place the order which will take a few days.
C4. Quantity
The quantity delivered is that shown on the Seller’s Delivery Note or Documentation. The delivery may be made at the discretion of the Seller in the absence of the Buyer. If no verification or query of quantity is made by the buyer at the time of delivery, this documented quantity will be accepted by the Buyer as being correct. If the Buyer or his Representative insist on mounting the delivery vehicle, they do so at their own risk. Any dispute regarding this matter must be advised to the Seller within five days of the delivery.

D1. Price

The Buyer will make and the Seller will collect payment through the checkout process on the Website at the time of order. A secure server will operate all card payments made online. The Buyer will have to re-enter payment details with each order.
D3. Cancellation of Order
Any order may be cancelled by a Buyer before collection. The Seller will process the refund to the payment card used to place the order which will take a few days.
D4. Title and Risk
Risk will transfer on collection of the goods. The goods remain the sole and absolute property of the Seller until such time as the Buyer has paid to the Seller the full and agreed price.
D5. Click and Collect
Click and Collect orders can be made any time at any time on the Seller’s website.
The Seller will aim to have orders available for collection within two working days of the order being placed.
The Seller will send out an email confirmation once the items are available for collection from the Sellers depot in Oxhill. Orders can not be collected before this email confirmation has been received.
All orders must be collected within 5 working days of receiving the collection notification. If not collected within the timeframe the Seller reserve the right to automatically cancel and refund any orders within the timeframe.
The Buyer is responsible for providing suitable and safe transport for any goods purchased.
D6. Liability
The Seller shall not be liable for goods once they have been collected from them.
D7. Force Majeure
